TERMS OF SERVICE

Effective Date: September 8, 2026

Welcome to CulinaNest. These Terms of Service (“Terms”) govern your access to and use of our online store, including browsing merchandise, reviewing product information, placing orders, making payments, and communicating with us about purchases or store services.

For purposes of these Terms, “CulinaNest,” “we,” “us,” and “our” refer to CulinaNest. “You,” “your,” “customer,” and “user” refer to any person who visits, accesses, purchases from, or otherwise interacts with our online store.

By accessing our website or submitting an order, you agree to these Terms together with the policies, product instructions, and other notices applicable to your transaction.

1. ABOUT CULINANEST

CulinaNest operates an online retail store that may offer kitchenware, dining products, cookware accessories, food-preparation tools, serving products, storage solutions, tabletop merchandise, household accessories, and other home-living goods.

Our assortment may change as products, collections, and new categories become available.

2. OTHER POLICIES THAT APPLY

These Terms should be read together with our:

Privacy Policy;
Shipping Policy;
Return & Refund Policy;
Product-specific instructions;
Safety information;
Promotional conditions; and
Any additional notices displayed before purchase.

Where product-specific conditions apply, those conditions supplement these Terms.

3. CUSTOMER ELIGIBILITY

You must have the legal capacity required under applicable law to enter into a purchase transaction.

If you have not reached the applicable age of majority, purchases should be made only with appropriate authorization or involvement from a parent or legal guardian where required.

4. CUSTOMER REVIEW BEFORE PURCHASE

Customers are responsible for reviewing product information before ordering.

For kitchen and dining merchandise, this may include:

Dimensions;
Capacity;
Materials;
Heat tolerance;
Food-contact suitability;
Appliance compatibility;
Care instructions;
Included components; and
Product-specific warnings.
5. PRODUCT DESCRIPTIONS

CulinaNest makes reasonable efforts to provide useful and accurate product descriptions.

Listings may include:

Product photographs;
Materials;
Dimensions;
Capacity;
Features;
Included components;
Care instructions;
Intended use; and
Other relevant specifications.

Some information may be provided by manufacturers, distributors, or suppliers.

6. PRODUCT MEASUREMENTS

Dimensions, weights, capacities, and similar specifications may be approximate unless expressly stated otherwise.

Minor manufacturing tolerances may occur.

Customers should verify dimensions carefully where merchandise must fit a specific cabinet, countertop, shelf, drawer, appliance, table, or storage area.

7. MATERIAL VARIATIONS

Products may be made from glass, ceramic, metal, stainless steel, wood, silicone, plastic, textiles, composite materials, or other household materials.

Minor differences in grain, color, finish, texture, surface appearance, or pattern may occur naturally or through manufacturing.

Such variations do not necessarily indicate a defect.

8. PRODUCT COLORS AND APPEARANCE

We make reasonable efforts to represent merchandise accurately.

Actual colors, patterns, finishes, textures, and visual details may differ slightly because of:

Photography;
Lighting;
Device settings;
Screen calibration;
Production variations; or
Material characteristics.

Exact digital color reproduction cannot be guaranteed.

9. PRODUCT PHOTOGRAPHY

Product images may contain food, beverages, furniture, utensils, plants, décor, appliances, or other objects used for demonstration or styling.

Only products expressly identified as included in the applicable listing form part of your purchase.

10. MULTI-PIECE SETS

Certain products may be sold as sets or include several components.

Customers should review the listing to determine the exact number of pieces and accessories included.

Items appearing in photographs for decorative purposes are not included unless expressly stated.

11. FOOD-CONTACT MERCHANDISE

Products intended for food or beverage contact should be cleaned before first use where appropriate.

Customers should follow applicable instructions concerning:

Washing;
Sanitizing;
Food storage;
Temperature limitations;
Dishwasher compatibility;
Microwave compatibility; and
Continued use.
12. MICROWAVE COMPATIBILITY

Customers should not place merchandise in a microwave unless the product is expressly described as microwave-safe.

Some metals, decorative finishes, plastics, woods, glass types, and other materials may not be suitable for microwave use.

13. OVEN AND STOVETOP USE

A product should not be assumed suitable for an oven, stovetop, broiler, grill, or direct flame unless such compatibility is expressly stated.

Using merchandise beyond its intended temperature range may result in damage or safety risks.

14. DISHWASHER USE

Dishwasher compatibility varies among products and materials.

Customers should follow applicable cleaning instructions rather than assuming that merchandise is dishwasher-safe.

High heat or harsh dishwasher detergents may affect certain finishes, coatings, woods, plastics, or decorative materials.

15. FREEZER AND REFRIGERATOR USE

Food-storage products should be used within their stated temperature limitations.

Not all containers or materials are intended for freezing or extreme temperature transitions.

Applicable product guidance should be followed.

16. GLASSWARE AND CERAMICS

Glass, ceramic, porcelain, and similar merchandise may be fragile.

Customers should inspect these products before use.

Products that become materially chipped, cracked, fractured, or otherwise unsafe should no longer be used.

17. TEMPERATURE SHOCK

Unless expressly designed for rapid temperature changes, fragile kitchen materials should not be moved immediately between extreme hot and cold environments.

Thermal shock can damage glass, ceramic, and similar products.

18. SHARP TOOLS

If CulinaNest offers knives, slicers, peelers, graters, mandolines, skewers, or other cutting products, customers should use them carefully and according to applicable instructions.

Sharp products should be stored safely and kept away from children where appropriate.

19. COOKWARE

Cookware and cooking accessories should be used only with compatible heat sources and within applicable temperature limits.

Customers should review instructions concerning:

Preheating;
Burner size;
Oven compatibility;
Handle temperatures;
Utensil selection;
Cleaning; and
Storage.
20. COATED SURFACES

Products containing nonstick, enamel, paint, plating, or other surface treatments should be handled according to applicable care instructions.

Excessive heat, abrasive cleaners, metal utensils, or unsuitable cleaning methods may damage certain coatings.

21. FOOD STORAGE PRODUCTS

Containers, jars, bottles, lids, bags, or food-storage systems should be used only within their intended limitations.

Customers should confirm whether a product is suitable for:

Hot liquids;
Refrigeration;
Freezing;
Microwave reheating;
Dishwasher cleaning; and
Transport.
22. LEAK-RESISTANT PRODUCTS

A product described as leak-resistant should be used according to its design and closure instructions.

Leak resistance may depend on correct lid placement, seals, product condition, and intended orientation.

Unless expressly stated otherwise, leak resistance does not necessarily mean that a product is permanently leakproof under all conditions.

23. KITCHEN ORGANIZATION PRODUCTS

Racks, shelves, drawer organizers, pantry products, holders, hooks, and similar merchandise should be used within stated dimensions and weight limits.

Customers are responsible for confirming that supporting surfaces and storage spaces are appropriate.

24. ASSEMBLY AND INSTALLATION

Some home or kitchen organization products may require assembly, mounting, setup, or adjustment.

Customers should follow applicable instructions.

Where specialized tools or technical skills are reasonably required, customers should obtain appropriate assistance.

25. WEIGHT AND CAPACITY LIMITS

Where a product includes a stated weight, volume, or load limit, customers should not exceed it.

Overloading can damage merchandise or create safety risks.

26. CLEANING AND MAINTENANCE

Customers should follow applicable care instructions.

Depending on the material, merchandise may be damaged by:

Abrasive cleaners;
Harsh chemicals;
Steel wool;
Excessive soaking;
High heat;
Prolonged moisture; or
Improper drying.
27. STORAGE AFTER USE

Kitchen and dining merchandise should be appropriately dried and stored after cleaning where relevant.

Moisture, heat, sunlight, or unsuitable storage conditions may affect certain materials.

28. PRODUCT SAFETY

Customers should follow all applicable safety warnings, instructions, temperature limitations, and usage guidance.

Products should not be used in a manner materially inconsistent with their intended purpose.

Nothing in these Terms limits mandatory product-safety protections under applicable law.

29. PRODUCT AVAILABILITY

All merchandise is offered subject to availability.

Adding an item to a cart does not permanently reserve inventory.

Products, colors, sets, sizes, or variants may become unavailable before fulfillment.

If paid merchandise cannot be supplied, any amount owed will be refunded.

30. LIMITED OR SEASONAL PRODUCTS

Certain collections, bundles, finishes, colors, or seasonal products may be available only while supplies last.

CulinaNest does not guarantee that sold-out or discontinued products will be restocked.

31. QUANTITY LIMITS

We may establish reasonable purchase limits for products, customers, promotions, households, accounts, or transactions.

Orders exceeding applicable limits may be adjusted or canceled.

Any amount owed for canceled paid merchandise will be refunded.

32. PRODUCT PRICING

Prices may change for future purchases.

The price properly displayed during checkout when an order is submitted will generally apply to that transaction, subject to correction of genuine errors where permitted by applicable law.

33. TAXES AND CHECKOUT TOTALS

The final checkout amount may include:

Merchandise charges;
Applicable taxes;
Shipping fees;
Promotional discounts; and
Other amounts disclosed before payment authorization.

Customers should review the complete amount before completing a purchase.

34. SALES AND PROMOTIONS

CulinaNest may periodically offer discount codes, sales, promotional bundles, gifts with purchase, or other special pricing.

Promotions may include conditions concerning:

Eligible products;
Minimum purchase amounts;
Expiration dates;

Dimensions;
Capacity;
Inventory;
Photographs;
Promotional details; or
Other specifications.

CulinaNest may correct genuine errors when identified.

36. MATERIAL ERRORS AFFECTING ORDERS

If a material error is identified before fulfillment, we may contact the customer with corrected information or cancel the affected merchandise where appropriate.

Any amount owed for canceled paid merchandise will be refunded.

37. SUBMITTING AN ORDER

Completing checkout constitutes your request to purchase the merchandise identified in the order.

An automated confirmation generally acknowledges receipt of your request.

It does not necessarily constitute final acceptance or guarantee fulfillment.

38. ORDER VERIFICATION

Before fulfillment, CulinaNest may reasonably review:

Inventory availability;
Variant availability;
Payment authorization;
Billing information;
Shipping details;
Purchase quantities; and
Transaction security.

Additional information may be requested where reasonably necessary.

39. ORDER ACCEPTANCE OR CANCELLATION

CulinaNest may accept, decline, hold, or cancel an order for legitimate reasons.

Examples may include:

Product unavailability;
Failed payment authorization;
Material pricing or listing errors;
Incomplete transaction information;
Reasonable fraud concerns;
Unauthorized payment activity;
Delivery limitations; or
Applicable legal requirements.

If paid merchandise is canceled, any amount owed will be refunded.

Independent payment processors or financial institutions may process payments on our behalf.

42. TRANSACTION SECURITY

CulinaNest may use reasonable measures intended to identify potentially fraudulent or unauthorized transactions.

Orders presenting legitimate security concerns may be delayed for verification.

Customers must not knowingly use unauthorized payment information, provide materially false billing details, impersonate another purchaser, or attempt to bypass security procedures.

43. SHIPPING

Order processing and shipment are governed by our separate Shipping Policy.

Customers should review that policy for applicable information concerning:

Processing periods;
Shipping methods;
Shipping charges;
Estimated delivery periods; and
Geographic delivery limitations.
44. DELIVERY ESTIMATES

Delivery dates and transit periods are estimates unless expressly identified as guaranteed.

Carrier operations, weather, holidays, transportation disruptions, seasonal demand, address issues, or circumstances outside our reasonable control may affect delivery.

45. SHIPPING ADDRESS RESPONSIBILITY

Customers must provide a complete and accurate delivery address.

If you identify an address error after ordering, contact CulinaNest promptly.

We may attempt to correct eligible information before shipment, but changes cannot be guaranteed after fulfillment or carrier processing begins.

46. MULTIPLE SHIPMENTS

Orders containing multiple products, sets, or larger items may occasionally be shipped in separate packages.

Different packages may have separate tracking information or delivery dates.

Receipt of one package does not necessarily mean that the complete order has been delivered.

47. ORDER MODIFICATIONS

Customers may request changes before fulfillment has progressed too far.

Depending on order status, we may be unable to change:

Product;
Color or variant;
Quantity;
Shipping details; or
Other transaction information.

A requested modification becomes effective only when confirmed by CulinaNest.

48. CANCELLATION REQUESTS

Customers may request cancellation while fulfillment can reasonably be stopped.

Submitting a cancellation request does not guarantee cancellation.

Once merchandise has shipped, available options will generally be governed by our Return & Refund Policy.

49. RETURNS AND EXCHANGES

Our separate Return & Refund Policy governs eligibility and procedures for returns and exchanges.

Applicable requirements may concern:

Return deadlines;
Merchandise condition;

Tags or labels;
Assembly status;
Proof of purchase; and
Product-specific exclusions.

Nothing in these Terms limits mandatory consumer rights that cannot legally be waived.

50. CONDITION OF RETURNED KITCHEN PRODUCTS

To the extent permitted by applicable law, return eligibility may be affected when merchandise has been materially:

Used;
Washed;
Cooked with;
Assembled;
Installed;
Scratched;
Stained;
Altered; or
Damaged after delivery.

Customers should review our Return & Refund Policy before substantially using merchandise they may wish to return.

51. FOOD-CONTACT RETURNS

Certain kitchen, dining, food-storage, drinkware, or other food-contact products may have additional return conditions for hygiene or product-integrity reasons.

Where permitted by applicable law, eligibility may be affected after a product has been used with food or beverages, washed, opened, or materially changed from its original condition.

52. REFUND PROCESSING

Approved refunds will be handled according to our Return & Refund Policy.

Where appropriate, refunds will generally be submitted through the original payment method.

Banks, card issuers, and payment providers may require additional time to make refunded funds available.

53. DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS

Customers should inspect merchandise reasonably promptly after delivery.

If a product arrives damaged, defective, incomplete, or materially different from what was ordered, please contact CulinaNest.

We may reasonably request:

Your order number;
A description of the issue;

Photographs of damaged components; and
Photographs of relevant packaging.

Available remedies will be determined according to our policies and applicable law.

If an item is materially chipped, cracked, bent, broken, incomplete, or otherwise unsafe, customers should not use it and should contact us.

55. PRODUCT RECALLS AND SAFETY NOTICES

If merchandise sold through CulinaNest becomes subject to an applicable recall or significant safety notice, customers should follow instructions issued by the responsible manufacturer, supplier, or regulatory authority.

Where appropriate, CulinaNest may take reasonable steps to communicate relevant information to affected customers.

56. CUSTOMER ACCOUNTS

If account functionality is available, customers are responsible for maintaining reasonable security over their login credentials.

Please contact us if you suspect unauthorized account access.

We may temporarily restrict account functionality where reasonably necessary to investigate suspicious activity or protect store security.

Please review that policy together with these Terms.

CulinaNest makes reasonable efforts to maintain reliable online store functionality.

Maintenance, cybersecurity measures, technical failures, software updates, network interruptions, or third-party outages may temporarily affect availability.

Continuous or error-free operation is not guaranteed.

66. CHANGES TO PRODUCTS AND SERVICES

CulinaNest may introduce, modify, replace, suspend, or discontinue merchandise, collections, website features, or services.

Changes to future offerings do not eliminate obligations relating to completed purchases or mandatory consumer protections.

This provision does not require you to assume responsibility that applicable law requires CulinaNest to bear.

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, it will be limited or severed only to the extent necessary.

The remaining provisions will continue in effect.

71. RESTRICTION OR TERMINATION OF ACCESS

You may stop using CulinaNest at any time.

We may restrict or suspend access where reasonably necessary because of fraud, unlawful conduct, serious security concerns, substantial misuse, or material violation of these Terms.

Provisions intended by their nature to survive termination remain effective to the extent permitted by applicable law.

These policies supplement the Terms and provide additional conditions concerning their respective subjects.

73. ENTIRE AGREEMENT

Our failure to enforce a provision on one occasion does not automatically waive our right to enforce that provision in the future.

74. GOVERNING LAW

These Terms are governed by applicable laws of the United States and, where applicable, the laws of the State of California.

Nothing in these Terms is intended to waive, reduce, restrict, or eliminate mandatory consumer protections, statutory rights, or remedies available under applicable law.
